Our Role as an Intermediary

Memorii Journeys acts solely as a travel advisor and intermediary.

We do not own, operate, or manage:

• cruise lines
• airlines
• hotels or villas
• yachts
• transportation companies
• on-the-ground experience providers
• tour operators or guides

Your contract for all travel services is directly with the relevant supplier, not with Memorii Journeys.

We are not responsible for the acts, omissions, or performance of any supplier.

Cruise Line Contract of Carriage (Critical Protection)

For all cruise bookings, the cruise line’s Contract of Carriage governs the terms of travel.

By booking through Memorii Journeys, you acknowledge and agree that:

• your legal contract is with the cruise line
• cruise lines may modify itineraries, schedules, ports, or vessels at their discretion
• Memorii Journeys has no control over cruise line operations or decisions
• Memorii Journeys is not liable for delays, cancellations, denied boarding, itinerary changes, mechanical issues, port restrictions, or ship substitutions

All rights, remedies, and limitations are determined by the cruise line, not Memorii Journeys.

Cruise Line Service Failure or Insolvency

Memorii Journeys is not liable for any financial loss or disruption resulting from:

• cruise line bankruptcy or insolvency
• operational failure
• inability to provide contracted services
• government restrictions or port closures
• mechanical breakdowns
• cancellation of voyages

Refunds or credits, if any, are solely at the discretion of the cruise line.

Itinerary Modifications by Cruise Lines

Cruise lines may alter itineraries for reasons including, but not limited to:

• weather
• safety
• mechanical issues
• port congestion
• government regulations
• operational needs

Memorii Journeys is not responsible for any impact of such changes, and we will issue no compensation or refunds for itinerary adjustments.

Health, Safety & Boarding Requirements (Cruise Lines)

Cruise lines may impose mandatory health, safety, and boarding protocols. This may include:

• vaccinations
• testing
• medical screening
• denied boarding due to illness or exposure
• quarantine or disembarkation requirements

Memorii Journeys is not liable for costs associated with:

• denied boarding
• medical treatment
• quarantine
• missed sailing
• additional accommodation or travel expenses

All such costs are the responsibility of the traveler.

Bookings & Pricing

• Bookings are subject to supplier availability and are not confirmed until written confirmation is received.
• Prices may change due to supplier policies, availability, taxes, or currency fluctuations.
• Foreign exchange fees, bank fees, and credit card processing fees are the responsibility of the client.
• Deposits are often non-refundable and vary by supplier.

Failure to pay on time may result in cancellation and forfeiture of deposits.

Payment Authorization

By providing your payment details, you authorize Memorii Journeys to:

• charge your card directly, or
• transmit your payment information to suppliers

Charges may appear under the supplier’s name rather than Memorii Journeys.

Cancellations, Amendments & Refunds

• Cancellation and change policies are determined by the supplier.
• Refunds, if any, are issued by suppliers and cannot be guaranteed by Memorii Journeys.
• Administrative fees may apply for changes or rebooking handled by Memorii Journeys.
• Supplier change penalties apply and vary by provider.

Memorii will advocate on your behalf, but final decisions rest solely with the supplier.

Travel Insurance

We strongly recommend comprehensive travel insurance covering:

• trip cancellation
• medical expenses
• evacuation
• baggage loss
• supplier default
• missed connections

All claims must be filed directly with the insurance provider.
Memorii Journeys is not responsible for losses that could have been covered by insurance.

Traveler Responsibilities

Travelers are responsible for:

• providing accurate personal details
• verifying passport names, dates, and correctness
• obtaining passports, visas, vaccinations, and required documents
• complying with local laws and entry requirements
• arriving on time for flights, transfers, and embarkations

Memorii Journeys is not liable for disruptions caused by traveler error.

Itineraries, Images & Representation

All itineraries, descriptions, photos, and visuals on our website or marketing materials are for illustrative and representational purposes only.
Actual accommodations, ships, villas, aircraft, rooms, or experiences may vary.

Suppliers may change equipment, suites, or offerings without notice.

Limitation of Liability

To the fullest extent permitted by law:

Memorii Journeys is not liable for:

• injury, illness, death, delay, or property damage
• supplier actions, omissions, or negligence
• weather disruptions or natural events
• government restrictions or force majeure
• lost, stolen, or damaged belongings
• missed connections, schedule changes, or denied services

Our maximum liability is limited to the amount paid to Memorii Journeys for advisory services, excluding supplier payments.

All travel is undertaken at your own risk.

Indemnification

You agree to indemnify and hold harmless Memorii Journeys from claims, damages, liabilities, and expenses arising from:

• your actions or omissions
• violations of these Terms
• supplier disputes
• damages caused by you during travel

Errors & Omissions

Memorii Journeys strives for accuracy, but is not responsible for:

• typographical errors
• supplier changes
• outdated information
• pricing inaccuracies

We reserve the right to correct errors at any time.

Force Majeure

We are not liable for failure to perform due to events beyond our control including:

• natural disasters
• pandemics
• wars or terrorism
• strikes
• government actions
• extreme weather
• civil unrest

Where possible, we will work with suppliers to arrange credits or rescheduling, but refunds cannot be guaranteed.

Governing Law

These Terms are governed by the laws of the State of Delaware, USA.
All disputes will be resolved exclusively in Delaware courts.

Changes to These Terms

We may update these Terms at any time.
